These Terms of Service (“Terms”) and Privacy Policy (“Policy”) govern your access to and use of the MyTidiest application (the “App”) provided by Otoigna S.L. (“Otoigna,” “we,” “us,” or “our”), commercial name MyTidiest. By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and the Policy.

What is www.mytidiest.com?

Our website, hosted under the domain www.mytidiest.com, and its subdomains contain a technological platform that we make available to our users so that they can create, organize, and manage digital inventories of their personal belongings, rooms, boxes, and spaces (hereinafter, the “Main Services”).

MyTidiest merely facilitates the cataloguing and organization of items, as well as providing tools and inspiration for tidying and storage.

Access and acceptance of the General Conditions

When accessing or using the Website and Apps, you are doing so under your sole and exclusive responsibility, and assume the status of user (hereinafter, “User” or “Users”), which implies that you have read and that you understand and unreservedly accept these General Conditions in their latest published version.

We reserve the right to expand, modify, replace and/or cancel our Services and/or these General Terms and Conditions at any time. In any case, we will do our best to notify you of any significant changes to the General Conditions sufficiently in advance. We advise you to review these General Conditions frequently to be aware of any changes we may have made. Any use of the Website and Apps must comply with these General Conditions, any Specific Conditions that may apply, MyTidiest’s usage policies and user guides, as well as all applicable United States laws, principles of good faith, and standards of decency and public order.

Information that constitutes misleading, fraudulent, or deceptive advertising or content.

Content that includes personal data of third parties without their express consent.

False or inaccurate content that could mislead other users of the Services.

In addition, you may not:

Use the Website or Apps for unlawful purposes, including resale, transfer, or unauthorized use by third parties.

Introduce malware, viruses, or any other code or system intended to disrupt or damage MyTidiest’s or third-party systems.

Infringe upon MyTidiest’s intellectual property rights or otherwise damage the reputation of MyTidiest or third parties.

Use the login details or account of another Registered User without authorization.

Access, monitor, or copy any content or information from the Website or Apps using automated systems (such as robots, spiders, or scrapers) without our prior written permission.

Circumvent or attempt to bypass any access controls, security measures, or restrictions contained on the Website or Apps.

Take actions that, in our judgment, place an unreasonable or disproportionately large burden on our infrastructure.

Create links to, display, or mirror any content from the Website or Apps within other websites or services without our prior written consent.

Uploading Content

When you upload content to MyTidiest (such as inventory entries, photos of items, rooms, or boxes), that content remains private to your account and is not visible to other users.

You must provide accurate, truthful, and up-to-date information for your own records. By uploading content, you confirm that you are the rightful owner of such content or have the necessary rights to store it in the app.

You agree not to upload any unlawful, misleading, defamatory, obscene, or infringing material. MyTidiest reserves the right to suspend, edit, or remove content that violates these General Conditions or applicable law.

You are solely responsible for the accuracy and legality of the information and media you upload. MyTidiest does not verify the truthfulness of user-uploaded content and disclaims liability for any damages resulting from inaccurate or unlawful uploads.

By uploading images or other media, you warrant that you hold the necessary rights to store them and agree to hold MyTidiest harmless against any third-party claims arising from their inclusion in your account.

License and Intellectual Property; Acceptable Use

License. Subject to your continued compliance with these Terms, Otoigna grants you a limited, revocable, non‑exclusive, non‑transferable, non‑sublicensable license to install and use one copy of the App solely for your personal or internal business purposes. Otoigna retain all right, title, and interest in and to the App and all related intellectual property. These Terms do not transfer any ownership rights to you.

Acceptable Use. You shall not (and shall not permit any third party to): (a) copy, modify, translate, adapt, or create derivative works of the App; (b) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App except to the extent such restriction is prohibited by applicable law; (c) resell, rent, lease, loan, sublicense, distribute, or otherwise make the App available to third parties; (d) circumvent, disable, or interfere with security‑related features; (e) scrape, harvest, or access the App by automated means (including bots, spiders, or similar tools) except through publicly documented interfaces we provide; or (f) use the App to build a competing product or service or in any manner that infringes, misappropriates, or violates any rights of Otoigna or any third party.

Subscription Services and Payment Terms

Payments via Apple. All purchases, billing, refunds, and proration (where applicable) are handled exclusively by Apple’s App Store In‑App Purchase (IAP) system. Otoigna does not collect or store payment card details. You must manage cancellations, upgrades, and downgrades via your Apple ID settings. Refunds, if any, are governed by Apple’s policies. Taxes/VAT may apply based on your App Store region.

Price Changes. We may change subscription prices in accordance with App Store processes.

AI-Generated Images

Images displayed in the App or on the Website may be created using artificial intelligence. They are provided solely for illustrative and inspirational purposes and do not depict real people, places, or objects. MyTidiest makes no claim that such images represent actual scenes or individuals.

Content Delivery and Storage; Technical Logs; Third‑Party Services

Local Storage. User‑created content (e.g., item lists, categories, photos) is stored locally on your device. We do not host or back up your personal content on our servers.

MyTidiest’s liability Our liability is that legally established by Act 34 of 11 July 2002 on Information Society and Electronic Commerce and by Regulation (EU) 2022/2065 of the European Parliament and of the Council of 19 October 2022 (Digital Services Regulation), which state that, in general, we cannot be held liable for information published at the Users’ request.

Although we strive to ensure that the content posted is correct, we are under no obligation to exercise prior control over the truthfulness, accuracy, lawfulness, relevance or suitability of the material published on the Website and Apps, as it is stored at the Users’ request. However, in the event of detecting or suspecting any unlawful act or any act contrary to these General Conditions or the Specific Conditions, we will act with due diligence to remove the information concerned or make access to it impossible in accordance with the regulations in force.

MyTidiest accepts no liability whatsoever for any damages or losses that may arise from the relationship between Users as a result of their contacts or negotiations.

The Additional Services shall be governed by the terms set out in the Specific Conditions, and MyTidiest, in relation thereto, bears the responsibility that corresponds to it by law or under the contractual terms and conditions. Regarding the advanced electronic signature service, MyTidiest shall not be liable under any circumstance for documents unsuitable for signature, uploaded, published or sent to other recipients by Users; or that have not been signed validly and/or properly, in accordance with the criteria provided for in applicable regulations and in these General Conditions. Access to and use of the Website and Apps requires a computer device or equipment and an internet connection and you agree that you will bear the associated costs.

We are not responsible for the existence of any liens, encumbrances, rights, disputes, mortgages, incidents, seizures or redeemable loan that may affect the properties advertised on our website and Apps, and you agree to hold MyTidiest harmless from any liability or damage in this regard.

We are not responsible for the accuracy, completeness, truthfulness, lawfulness or suitability of the information, materials and/or content available on third-party websites that you may access through links available on our Website and Apps. MyTidiest’s liability for using artificial intelligence MyTidiest uses artificial intelligence technologies to optimize our Services and improve the experience of our Users. Our commitment is to use these tools in an ethical, responsible manner and in compliance with applicable regulations, always ensuring that their implementation benefits our Users in a fair and transparent way.

While artificial intelligence technology offers great opportunities, at MyTidiest we are aware of the need to ensure its proper and transparent use. For this reason, we ensure compliance with applicable laws and regulations, continuously adapting the use of these technologies to current regulations and the highest standards of responsibility.

In any case, by using our services, Users accept and understand the implications of such artificial intelligence tools and agree to use them in a responsibly and in compliance with the law and third-party rights. Although at MyTidiest we make every effort to be as accurate as possible, we cannot guarantee that errors will not occur when using artificial intelligence technologies, as this is a matter beyond our control (we are not always suppliers of these tools and therefore, do not manage their operation or development).

Any interaction with our systems involves the processing of data and information of all types, which Users must use with due care so as not to violate the rights of third parties (i.e. they must not use the text, data or confidential information of third parties unless they have express prior authorisation to do so). With respect to personal data, we are committed to protecting the privacy of the Users pursuant to our Privacy Policy, which is regularly updated, as well as the measures adopted for such purpose. Users may not use the personal data of third parties unless they have expressly consented to such use, in the context of these artificial intelligence technologies.

Technical Logs Our servers may temporarily process technical information (such as IP addresses, timestamps, and request metadata) solely for delivery, security, performance optimization, and service functionality. This information is not used for tracking or profiling and is not linked to an identified natural person by us.

Third‑Party Services. Certain features or transactions rely on third parties (e.g., Apple App Store). Those third‑party services are governed by their own terms and privacy policies, for which Otoigna is not responsible. Where you complete purchases through Apple, Apple is your merchant of record for billing purposes.

Service Changes and Availability

We may, at our discretion, add, remove, or modify features or content feeds; issue updates or upgrades; or suspend or discontinue all or part of the App. The App may be unavailable, interrupted, or subject to delays, including due to platform changes, maintenance windows, or network/provider outages. We do not guarantee continuous or error‑free availability.

Disclaimers; Limitation of Liability; Content Loss

Disclaimers. The App and all content are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, and non‑infringement. We do not warrant that the App will be uninterrupted, secure, or error‑free, or that defects will be corrected.

Content Loss. You are solely responsible for safeguarding your on‑device content (including creating your own device backups). Otoigna is not liable for any loss, corruption, or deletion of content, including where such loss results from software updates, upgrades, maintenance, device failure, or user actions.

Limitation of Liability. Otoigna shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, data, goodwill, or other intangible losses, arising out of or relating to your use of or inability to use the App, even if advised of the possibility of such damages.

Operational Interruptions

Otoigna shall not be liable for any delay, failure, or degradation in performance resulting from events or circumstances beyond its reasonable control, including but not limited to platform or App Store policy changes, operating system changes, updates or upgrades (whether by Otoigna, Apple, or third‑party platforms), network failures, denial‑of‑service events, power outages, or other force majeure events.

Governing Law and Jurisdiction

To the extent applicable, U.S. federal law and the laws of the State of California may also apply to certain users. These Terms are governed by the laws of Spain and applicable European Union law, without regard to conflict‑of‑law rules. You agree that the courts of Barcelona, Spain shall have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the App, except where mandatory law provides otherwise.

Amendments

We may update these Terms and this Policy from time to time. Changes are effective when posted within the App or on our website (as applicable). Your continued use of the App after changes become effective constitutes acceptance of the revised Terms and Policy.

Data category: what personal data will we use?

When you use our Website and Apps we may access to certain information and personal data of yours. We will explain throughout this text the type of personal information we will use in each case.

Category of personal data we may process:

◦ Contact details: When users contact us via email, we will process their email address and the content of their message exclusively for the purpose of managing and responding to the inquiry. Such information will not be incorporated into any database for commercial purposes, will not be disclosed to third parties, and will be retained only for the period necessary to address the communication.

Data retention

We keep personal data only as long as necessary for each purpose and then delete or irreversibly anonymize it.

Support messages (email, message text, IP, device/iOS version): kept up to 90 days after we close the ticket, unless longer is needed to resolve a security incident or comply with a legal obligation.
Technical/security logs (IP, timestamps, request metadata): kept up to 90 days for delivery, security, and abuse-prevention.
Analytics/cookies: kept as stated in the Cookie Policy (generally up to 12 months).
Account data in the App: stored locally on your device and retained until you delete it or uninstall the App. We do not host user inventories on our servers.
Payments: handled by Apple as merchant of record. We do not store your card data; we may retain related correspondence only as needed to handle your inquiry.

Where a longer retention is required by law, we will retain the data only for that period and restrict its processing to compliance purposes.

Rights of data subjects

We inform you that you may exercise the following rights:

Right to access your personal data to know whether they are subject to processing and the processing operations carried out with same;

Right of rectification of any inaccurate or incomplete personal data

The right to erasure of your personal data, where this is possible (without prejudice to cases where we are required by law to maintain the data blocked);

The right to object to the processing of your personal data, when the legal basis that enables us to process it is our legitimate interest. MyTidiest will cease processing your data unless it has compelling legitimate reasons or it is necessary for the defence against complaints.

The right to revoke the consent given to MyTidiest at any time.

Confidentiality and security

At MyTidiest we take all reasonable efforts to maintain the confidentiality of personal information processed through the Website and Apps and, where appropriate, other MyTidiest tools. We maintain strict levels of security to protect the personal data we process against accidental loss and against unauthorised access, processing or disclosure, taking into account the state of technology, the nature of the data and the risks to which it is exposed. However, we cannot be held responsible for the use you make of the data (including your username and password) that you use on MyTidiest beyond our tools, Website and Apps.
